County attorney clears Uber in deadly Tempe self-driving crash

The National Transportation Safety Board released a preliminary report in May saying the autonomous driving system on Uber's Volvo XC-90 SUV spotted Herzberg before hitting her, but didn't stop because the system used to automatically apply brakes in potentially unsafe situations had been disabled "to reduce the potential for erratic vehicle behavior".

"After a very thorough review of all the evidence presented, this Office has determined that there is no basis for criminal liability for the Uber corporation arising from this matter", Yavapai County Attorney's Office wrote in a letter to Maricopa County Attorney's Office.

Vasquez could face charges of vehicular manslaughter, according to a police report last June.

Polk's office said it would make no further comments about the case because it's still pending.

The National Transportation Safety Board has also been investigating the March 2018 crash. A Yavapai County prosecutor found that Uber is not criminally liable for the crash. The auto had a human operator behind the wheel but was in computer control mode at the time of the crash.

The crash occurred in March 2018, and involved a Volvo XC90 that Uber had been using to test its self-driving technology.

"The accident was a blow to the entire autonomous vehicle industry and led other companies to temporarily halt their testing", stated the report.

"We still have the option to review potential charges involving the driver [Rafaela Vasquez]", Montgomery told KTAR News 92.3 FM's Arizona's Morning News on Wednesday.

"A vehicle was damaged almost every other day in February", wrote Robbie Miller in a letter to several Uber executives.

The alleged attempt was seen as an effort to retaliate against CNN for its critical reporting on the Trump administration. A representative for Fox News did not immediately respond to an ABC News request for comment on the DNC's decision.

The company is now testing with two employees in the front seat and more strictly monitor safety employees.

Uber told New Times previous year that Vasquez had been trained on the capabilities and limitations of the vehicle, and was supposed to look at the road and prepare for any emergencies.

Uber has not resumed testing in San Francisco or Toronto, where it previously had programs.
