Judge dismisses one of the charges against Weinstein

The criminal case against disgraced film producer Harvey Weinstein sustained a blow Thursday when prosecutors with the Manhattan District Attorney's office dropped one of the charges against him.

He says that as of now, DiGaudio has "no active role" in the Weinstein investigation but remains on duty. A message left on a phone used by the detective in the past wasn't immediately returned. According to reports, one of the counts against Weinstein, involving Lucia Evans, has been dropped because investigators found a written account of the encounter that suggests it may have been consensual.

Manhattan District Attorney Cyrus Vance Jnr has already been fiercely criticised for declining to prosecute Weinstein when an Italian model accused him of grabbing her breasts in 2015.

There was no immediate response from the New York Police Department.

The revelation of numerous allegations about Weinstein, beyond the three women involved in the criminal case, helped spark the #MeToo movement against sexual harassment and sexual assault. They said they could not oppose the dismissal in light of information that they had learned while investigating the case.

"I'm not certain he [the judge] will have any choice but to dismiss the entire indictment against Harvey Weinstein".

Details emerged after the court unsealed a letter that Manhattan prosecutors wrote to Weinstein's lawyer, Benjamin Brafman, in September.

The defense said it would also subpoena police interview records after claiming an NYPD detective "may have unfairly tainted these proceedings" when he prepared Evans for her testimony.

The tossed count relates to Lucia Evans, who has accused Weinstein of forcing her to perform oral sex in 2004.

This decision comes after Weinstein's lawyers argued that there are legal problems with the criminal case against him.

The 66-year-old, who has been on $US1m bail since his arrest in May, has denied having non-consensual sex, his lawyers have previously said. Weinstein still faces charges for five additional sex crimes, including allegedly raping another woman in 2013, and sexually assaulting a third woman in 2006.

Weinstein says he is innocent. He also said he believed a police detective had corruptly attempted to influence the case by keeping the witness from testifying about her misstatements. Weinstein appeared in Manhattan Criminal Court on Thursday morning as Judge James Burke made a decision to dismiss count six of the eight-count indictment against the 66-year-old film producer. "If you have a person willing to commit perjury in the grand jury, that is as serious as the crime of sexual assault because it undermines the fairness of the process for all of us".
