Daniel Enrique Fabian: Gamer overheard ‘raping’ 15-year-old girl

An 18-year-old Florida man accused of sexually battering two girls in separate June incidents was heard assaulting one of the girls after forgetting to turn off the mic he was using to play Grand Theft Auto, authorities said.

According to the Fox 13, deputies arrested 18-year-old Daniel Enrique Fabian.

It's unclear how police connected with the witness who allegedly heard the assault.

Fabian then returned to the game some 15 minutes later to resume playing.

According to the police report, Fabian continued to have sex with the girl despite her telling him no four times.

The witness playing against him told police that Fabian said he was taking a break to "smash".

An examination supported the 15-year-old victim's allegation of sexual abuse, WFLA 8 reports.

Fabian was charged with lewd and lascivious battery of a person between the ages of 12 and 15.

According to the arrest report in the June 4 case, Fabian was born in Peru and is not a USA citizen. He is being held in lieu of $30,000 bond at Pasco County jail. It is not clear when he is scheduled to appear in court next in the June 28 case.

"I had no idea it was this close to us", Ed Holtzman, Fabian's neighbor, told WFLA-TV.
