Constitutional scholars are questioning whether changes could be made without Congress.

But Trump says the outdated policy is an abuse of the USA immigration system. He says "obviously as conservatives we believe in the Constitution".

One member of Congress, Republican US Senator Lindsey Graham said he would move forward to introduce legislation "along the same lines" as Trump's order.

Trump has mentioned the idea of voiding the amendment before, most notably in August of 2015, when the birthright issue became part of his hard-line policies on immigration as a presidential candidate. As Reason's Elizabeth Nolan Brown explained, birthright citizenship grants American citizenship to anyone born on USA soil. An 1898 Supreme Court decision held that the US -born son of legal Chinese immigrants was a citizen under the 14th Amendment; a footnote in a 1982 decision suggests there should be no difference for children of foreign-born parents whether they are in the USA legally or illegally.

Pence says the Supreme Court has never ruled on whether the language in the amendment applies specifically to people in the country illegally.

Trump spoke to "The Ingraham Angle" hours after the Pentagon announced it would deploy some 5,200 troops to the southern border in what the commander of U.S. Northern Command described as an effort to "harden the southern border" by stiffening defenses at and near legal entry points.

Mr Trump said America was the only country in the world to give birthright citizenship, although 30 other countries do so.

But Trump said he has talked to his legal counsel and was advised he could enact the change on his own, contrary to the view of many constitutional experts. CNN has reached out to the White House.

As Axios pointed out, more than 30 countries provide birthright citizenship, a lot of them in the Western Hemisphere.

Trump's use of an executive order would likely put the matter in the hands of the court.

Still, the threat of ending birthright citizenship amounts to another escalation in Trump's hardline approach to immigration, which has become his signature issue.

Trump's comments come ahead of the November 6 midterm elections. However, the president is confident in his ability to overturn the law.

As it stands, children born to non-US citizens on American soil have the right to United States citizenship in almost all circumstances.

"They're saying I can do it just with an executive order", Mr Trump said.
