Nebraska Executes Inmate With Drug Cocktail Including Fentanyl

After a federal appeals court rejected a pharmaceutical company's attempt to block Moore's execution, the almost four-decade inmate will be put to death using a never-before-used combination of the opioid fentanyl, valium, a muscle relaxant, and a substance that will stop his heart-which anti-death penalty advocate Sister Helen Prejean denounced as "human experimentation". That was after a long search, the court filing states; the director of the Nebraska Department of Correctional Services "contacted at least forty potential suppliers and six other states". The state's supply of one of the drugs used in the mixture to kill Moore expires at the end of this month and another expires in October.

"Murder is murder", said anti-death penalty protester Diane Reyes.

Moore was declared dead at 10:47 a.m.

They were given 40 seconds to observe the body before the curtains went up for a final time.

The execution, Nebraska's first since 1997, represented a stunning political turnabout in a state where lawmakers voted only three years ago to ban capital punishment.

Carey Dean Moore, 60, who had been on death row for 38 years, died by lethal injection in Nebraska.

Gov. Pete Ricketts is a staunch supporter of the death penalty.

Death penalty opponents have planned a 5 p.m. rally outside the Nebraska Capitol.

The light turnout stood in contrast to the 1994 execution of Harold Lamont Otey, when more than 1,000 people created a raucous, party-like atmosphere. Previously the electric chair was used.

The fatal drug cocktail used for Moore's execution had never been used to put a person to death, the Lincoln Journal Star reports.

Moore designated three people and one clergy member to witness his execution.

Moore launched no last-minute appeals to spare his life, but the USA arm of German drug maker Fresenius Kabi had sued unsuccessfully to prevent the state from using its products in a lethal injection, which it says could harm its reputation.

The use of fentanyl in executions has drawn some criticism, including from the American Civil Liberties Union, given the drug's role in the opioid epidemic. "Why must they remain there one day longer than all the years they have been there".

In 2016, Nebraska reinstated the death penalty.

Whether Moore would be executed on Tuesday as scheduled was thrown into question last week when the drug company Fresenius Kabi filed a federal lawsuit accusing Nebraska of obtaining lethal injection drugs "through improper or illegal means".

U.S. District Judge Richard Kopf ruled Friday that the company's claim of irreparable injury was speculative and there was no indication the state obtained the drugs through misrepresentation or by circumventing the company's distribution controls.

Moore's execution was the 16th in the United States this year, according to the Death Penalty Information Center. The Republican governor, a wealthy former businessman, has said he was fulfilling the wishes of voters in the conservative state. Moore had seen previous execution dates come and go and had expressed frustration with the repeated delays. Nebraska Attorney General Doug Peterson's office said in a statement that the "somber event serves to provide a measure of closure for what has been a lengthy enactment of justice".

The four media witnesses were brought inside the prison at 9:03am where they were read the execution plans.
