Stanford sex attack: Brock Turner's lawyer launches appeal

A California appeals court on Tuesday heard arguments about whether Brock Turner, the former Stanford swimmer, should be granted a new trial. Turner's lawyer, Eric Multhaup, was given 15 minutes to argue why the conviction should be overturned before a panel of three state appellate judges, composed of two women and one man. Multhaup argued that evidence against Turner was largely circumstantial.

Aviram said, "Because of the very high burden of proof on appeal - because the person is no longer presumed innocent, they're presumed guilty, they've already been found guilty - it's very, very hard to convince the court of appeals that a jury decision has been unreasonable".

When Turner was found on top of the woman, who was also unconscious and half-naked, he was fully clothed and did not have his genitals exposed.

Across Twitter, critics of Turner's lawyer's new defense are baffled, wondering how such as justification as "he didn't mean to" is supposed to obliterate a rape charge. Santa Clara County District Attorney Jeff Rosen said Turner received a fair trial and was justly convicted.

However, the judges did not appear to take Multhaup's arguments on board - if they understood them at all.

Turner, an OH native who's now 22, was found guilty of assault with intent to rape a blacked-out woman after a 2015 incident on the university campus. They are expected to reach their decision within 90 days.

Although prosecutors had sought a six-year term, Turner was sentenced to six months and released after serving only three.

Assistant Attorney General Alisha Carlile said that Multhaup presented a "far-fetched version of events".

"We have a jury system and the jury will seldom give reasons why they decide to convict or acquit", explained Aviram.

Californians were outraged at the judge's leniency in Turner's sentencing, and in June 2016 voted to recall Superior Court Judge Aaron Persky.

"There's no evidence at what point she went from being incapacitated from alcohol to loss of consciousness", he argued.

Given the progress in recent years in society's understanding of sexual violence and support for survivors, Pham, said, it was especially challenging to see Turner's attorney use such damaging language. According to public record, Turner is living outside of Dayton, Ohio, with his family and reportedly works for a landscaping company.
