Trump attorneys waive privilege on Cohen's secret recordings

"This is a very surprising tweet from the president this morning where he suggests his former lawyer, Michael Cohen, committed a crime". That conversation took place weeks before Trump's November 2016 election.

The recording was part of a large collection of documents and electronic records seized by federal authorities from the longtime Trump fixer earlier this year.

Giuliani said no campaign funding was involved in the discussion between Trump and Cohen, who has distanced himself from Trump in recent months as the FBI investigates Cohen's business dealings. Citing a person familiar with the recording, The Washington Post reported Friday that in it, Cohen and Trump discussed a plan to purchase the rights to McDougal's story from Pecker's company for about $150,000.

Giuliani's point is that Trump did nothing wrong - that before the conversation he knew nothing about any payments, noting that no payment was made and that he suggested paying by cash so there would be a record of it.

But he said no money was actually ever transferred, and the recording itself amounted to "powerful exculpatory evidence".

It is a potential problem for Mr Trump because undisclosed payments to bury embarrassing stories about a political candidate can be treated as a violation of U.S. campaign finance laws.

As for the legality of recording a private conversation, the content of what is on the alleged tape matters.

He said the recording was less than two minutes and demonstrated the president had done nothing wrong.

The New York Times first reported the existence of the recording. Presumably Trump and Cohen wanted to take over the rights to the tape so that they could be sure about the scandal staying on the down low.

Mr. Trump complained on Twitter Saturday morning that an attorney recording a client's conversation is "inconceivable".

Hicks also called McDougal's claim that she had an affair with Trump "totally untrue".

Transparency groups and Democrats have argued that the secret efforts to silence Trump accusers, including a payment to adult film actress Stormy Daniels, should be investigated by the Federal Election Commission as potential violations of campaign finance laws, which require disclosure of campaign expenditures.

One in particular features Trump and Cohen discussing an affair that Trump had back in 2006 with ex-playmate Karen McDougal. An attorney for Cohen called Trump's statement "false".

Cohen had made a practice of recording conversations, unbeknownst to those he was speaking with. In a CNN story earlier this month, a source close to Cohen indicated that "the truth is not you or your client's friend". "Any attempt at spin can not change what is on the tape", Davis said in a statement on Friday.

"It's pretty clear from the tape, it's the first time Trump is finding out".

"We have no knowledge of any of this", she said. The National Enquirer, however, did not publish the story.

Non-disclosure agreements of the type signed by Ms Daniels and allegedly by Ms McDougal are not in themselves illegal.
